2
Prima Facie Evidence of Registered Ownership
Establishes a presumption that the person named is the registered owner of the vessel.
3
Treaty Entitlement

REGISTRY vs STATUTORY CERTIFICATES
Aspect | Certificate of Registry | Statutory / Class Certificates
Purpose | Establishes identity, nationality & ownership | Establishes compliance & seaworthiness
Issued By | Registrar of Ships / Government | Recognised Organisation / Administration
What It Proves | Who the ship is & who owns it | That the ship meets safety, environment & other mandatory standards
Examples | Certificate of Registry | SOLAS, Load Line, MARPOL, ISM, ISPS Certificates
Key Point | Not a certificate of seaworthiness | Proves compliance & seaworthiness
IMPORTANT NOTES
• Certificate of Registry is not evidence of the equipments' condition or the vessel's seaworthiness.
• A ship with a valid registry certificate can still be unseaworthy and detained.
• Registration may be suspended or cancelled by the Government under the Act for specified grounds.

IMPLEMENTATION
BY STATES
A Member State,

Adopted by the
Committee by
a two-thirds
majority of
Contracting
Governments
present and

The IMO
Secretary-General
notifies all

Parties (usually
within 21 days
of adoption).
Parties may
accept, object,
or do nothing
within the period
specified in the
applicable
convention.
Amendment
enters into force
on the date
specified by
the convention
(timeline varies).
Flag States

amendments in
their national
laws and
procedures.
TWO AMENDMENT ROUTES
1. TACIT ACCEPTANCE PROCEDURE
(Most Technical Amendments)
Amendment enters into force automatically unless
a specified number of Parties object.
The objection period and entry-into-force timeline
are governed by the amendment provisions of the
specific IMO convention (e.g., SOLAS, MARPOL).
Example: MARPOL Annexes, SOLAS Chapters.
2. EXPLICIT ACCEPTANCE PROCEDURE
(Where Convention Requires)
Amendment enters into force only when it has
been accepted by the number of Parties
specified in the convention.
Common in some older instruments and
foundational articles.
KEY
POINTS
Standards evolve
without reopening
the entire treaty.
Stronger global
safety, security
and environmental
protection.
Participation
of Member States
ensures fairness
and consensus.
Always verify the
applicable convention
for amendment
requirements.
